DNA testing is routinely used in immigration cases to prove whether a child under 18 is a biological child of or, in some cases, is related to an individual with a leave to remain in the UK. Most DNA tests for immigration reasons are parentage testing (paternity or maternity) but in some cases a grand parentage or avuncular (whether a child is a nephew or a niece of the sponsor) test is employed to prove an alleged relationship. When the child is outside the UK, a DNA test is normally arranged by an ECO. In such cases, DNA samples are taken from applicants at a post overseas and sent to a UK-based laboratory together with the samples of the sponsor, which in most cases is taken in the UK. If the child is already in the UK, DNA testing could be conducted in a Home Office-appointed laboratory or arranged privately or via solicitor. The DNA testing report provides an assessment as to the nature of relationship between the tested individuals and states the probability of this relationship. According to the Home Office guidelines, in assessing DNA reports, the question to be addressed is whether the evidence establishes the relevant relationships on a balance of probability. If a DNA report concludes that the probability of a claimed relationship is at least three-times greater than any other relationship, it should normally be accepted as proof of that relationship without further enquiry. If the probability of the claimed relationship is only twice as likely (or less) than any other relationship, the case is usually reviewed as a whole. However, the Home Office admits that even a low balance of probability in favor of the claimed relationship is substantial evidence and should be accepted unless there is strong evidence to the contrary. The landmark immigration case Sarbah vs. Home Office (1985) was the first to use DNA testing to prove a mother-son relationship between Christiana Sarbah and her son Andrew. The case started in 1983 when Andrew, then 13, arrived in England after a long stay in Ghana with Christiana's estranged husband. Immigration officials held him at Heathrow Airport, claiming his passport was forged, or that a substitution had been made. Only after intervention by a local MP was Andrew allowed to stay at his family's home in London. Various genetic-determining tests showed that Christiana and Andrew were almost certainly related however, it was impossible to determine whether Christiana was his mother or merely an aunt (Christiana has several sisters in Ghana). The photographic evidence and depositions were rejected at an immigration hearing, but deportation was delayed pending an appeal. Around the same time, an article in The Guardian reported the discovery of DNA fingerprinting by Prof. Alec Jeffreys and his team at the University of Leicester. After reading about their work, the legal team dealing with the case approached Prof. Jeffreys, and he agreed to take on the case. In order to prove that Christiana was Andrew's mother, a DNA test was performed on blood samples from Christiana, Andrew, an unrelated individual, and Christiana's three undisputed children: David, Joyce, and Diana. Using a recently discovered DNA probe, a DNA fingerprint was produced which confirmed that Christiana was indeed Andrew's biological mother, and that David, Joyce and Diana were his siblings. According to INS, 69% of this unauthorized immigrant population was from Mexico. (USINS, 2003) However, the top 15 sending countries accounted for 89% of the total illegal alien population and included Mexico, El Salvador, Guatemala, Colombia, Honduras, China, Ecuador, Dominican Republic, Philippines, Brazil, Haiti, India, Peru, Korea, and Canada. This means that a significant number of illegal aliens entered the United States through other than the Mexico-US border and that they fall under the jurisdiction of the investigations section (interior enforcement), not the Border Patrol. These statistics further indicate that the illegal alien problem is both a border and an interior enforcement problem. More importantly, the interior problem seems to be far greater than the border problem. However, the INS never placed much emphasis on interior enforcement. As a matter of fact, there is very little interior enforcement of the immigration laws going on. Interior enforcement lags behind all other functions of the agency and the INS clearly prioritized the Border Patrol function. The sheer number of apprehensions along the Mexico-U.S. border often lures the observer to accept them as representative of the illegal alien problem. In 2002, the INS apprehended 1,062,279 deportable aliens in the United States and 94% of those apprehensions were from Mexico. Near the beginning of this year, President Bush was quoted as saying the United States needs an immigration system "that serves the American economy and reflects the American dream". As a result, regular, moderate consumption of wine by the American public continues to face ideological and legal impediments. The History of Wine Consumption During the Colonial Years Since its origins, the history of wine consumption in America has been both encouraged and despised by different demographic groups. Spanish missionaries produced the earliest New World wine during the early 17th Century. Shortly thereafter, French immigrants began to cultivate grapes in the Hudson River Valley. They made wine, juice, and preserves. The early history of wine consumption in America was dominated by immigrants whom were primarily Catholic, and of Central or Southern European descent. The bulk of wine-drinking immigrants came from the wine loving nations of France, Italy, Germany, and Spain. They descended from cultural traditions that valued social wine consumption with the evening meal. The aforementioned wine drinkers were counterbalanced by immigrants from Northern Europe. Many held Puritan belief systems that discouraged or banned alcohol consumption of any kind. The nativist movements of the early 18th Century cast suspician on immigrant groups that retained Old World customs and did not entirely assimilate into American society. This is a good thing for my editors since this means more readers and more readers mean more advertising revenue. It is good for me too in the sense that I do get some of the greatest writing topics from readers who write me. It can also be a bad thing?sometimes a very bad thing. What I enjoy are those readers' comments in which readers will take the time to attempt to offer me counter-arguments to the particular position I take in the op-ed pieces I write. What I mean is that there are some readers who realize that the process of clear and linear thinking is not an easy task. It takes work-hard work. One is not always successful-especially your humble columnist. And, when a reader takes the time to carefully craft and linearly constructed counter-argument, I appreciate it to no end. I appreciate the effort. I enjoy the challenge. However, most readers' responses I get are NOT carefully crafted, well-constructed counter-arguments. Without fear of contradiction, the vast majority of readers' responses I get are not just poorly constructed but are not counter-arguments at all. Let me give you an example. Here is someone who was attempting, and I credit her for the attempt, to challenge some pieces I wrote on the illegal alien issue: "And by the way, everything- the numbers, and the data I stated here- I can prove to you if you want me to. It is all true." This person believed that if she backed the dump truck up, pulled the lever, and dumped a deluge of "stats and facts" that this would constitute "proof" for her Minuteman Project position. She apparently believed that the "preponderance" of "facts" she could provide me constituted "proof" that she was right and I was wrong. Let me say that I did appreciate this person's attempt. Brown-skinned and with a marked foreign accent, they are subject to police profiling and harassment and all manner of racial discrimination. They are the new Jews of Europe- its Muslim minorities. Muslims- especially Arab youths from North Africa- are, indeed, disproportionately represented in crime, including hate crime, mainly against the Jews. Exclusively Muslim al-Qaida cells have been discovered in many West European countries. But this can be safely attributed to ubiquitous and trenchant long-term unemployment and to stunted upward mobility, both social and economic due largely to latent or expressed racism. Moreover, the stereotype is wrong. The incidence of higher education and skills is greater among Muslim immigrants than in the general population- a phenomenon known as "brain drain". Europe attracts the best and the brightest- students, scholars, scientists, engineers and intellectuals- away from their destitute, politically dysfunctional and backward homelands. The Economist surveys the landscape of friction and withdrawal: "Indifference to Islam has turned first to disdain, then to suspicion and more recently to hostility...
