Driving while under the influence is an illegal action, which is oftenknown as a misdemeanor in the court of law. Some states, on the first offense, will pull your license, impound your vehicle, and throw you in jail.Once you are at jail you will await to visit the judge, which is the next day, unless you are arrestedon the weekend, then you will visit the judge on Monday the following week. Your blood level mustread 0.8 in most states before you are considered operating under the influence or else driving underthe influence. Driving under the influence (DUI), operating under the influence (OUI), and driving while under theinfluence (DWI) are three terms for similar acts; however, the differences in some states can mean adifference in the penalty you receive. DUI OUI DWI laws are tricky since in few states the law musthave probable cause to pull you over. If you are not weaving on the highway or committing any crime that lead the officer to believe thatyou are driving under the influence, then you may have a chance in the courtroom to fight and winthe case. Moststates allow particular procedures to protect the home without deadly means. Human life is morevaluable than property; thus, if the intruder threatens to use deadly force on the home renter orowner, then the person has the right to use deadly force to protect himself or others against theperpetrator. For the most part, the culprit must illustrate signs of using deadly force to takepossessions from the home, has the intent to harm or kill the homeowner or renter, and has a weaponto carry out the act. If your life is actually in danger, then the perpetrator more than likely entered your home by force. In other words, the intruder must have broken in the home without any consent of your own and helda weapon in his or her hand with the intent of harming you. If you have a weapon and attempt to protect your self, it is advised in many states to shoot and killthe perpetrator, rather than injuring the party, since injury would put you at risk of manslaughterand or murder. It becomes your word against the other when injury is involved. Thus, in most states,if the perpetrator is merely robbing the property; and if you use deadly force to protect the home, then you are at risk of being charged with manslaughter and or murder. For example, in a trial where a man was charged of ? Capital Murder,? the man may have originally plead guilty, but may later in court --profess hisinnocence, claiming threats from legal representatives were made against him. The judge then wasresponsible to determine if the accusations were in fact true; and if the substantial evidence pendingagainst the defendant was sufficient to accept the plea of guilt. Thus, few judges may accept the plea if the judge feels it is not necessary for a jury or the public tohear the details of the case. The defendant then appears in court and may be offered a plea bargain,or in some cases no plea bargaining is offered. Thus, this man made the biggest mistake of his life, since he professed his innocence while pleading guilty of the charge. Facing the death penalty, theman is standing between the law and God, and praying that the higher source will come through forhim. (Check the Alford Case for more details, and Steinberger 1985) Pleas are accepted then by the residing judge in the courtroom. If you are accused of a crime nomatter how minor it may seem --it is important to learn more about pleas, since pleas are whatdetermines your appearance. If you are in ...

Legal Advice for the Poor What happens if I am accused of a crime and cannot afford an attorney? What if I am in an abusiverelationship and need a divorce, but cannot afford to pay a lawyer? What if my child is in troubleand I have no money? Everyday, poor citizens in America face ongoing problems and they often lack a resolution. If youare accused of a crime and do not have money to hire a lawyer, under law, the courts are obligatedto assign you criminal defense attorney to protect your rights. Few states may include the attorney fees in the costs and fines, but for the most part, the fees areminimal. Officers are notorious for setting up traps to lure alleged criminals into confessing ormaking mistakes that lead to their arrest. For example, in a small town, a drug task force is setup where undercover officers frequent bars tomonitor the crowd while acting like a customer in the establishment. What the officers are reallydoing is gathering information, witnesses, and other evidence that will lead to the arrest of a localdrug dealer. Officers also use entrapment procedures to lure in pedophiles over the Internet. When does entrapment become illegal? This is one of the main questions asked pertaining toentrapment and the answer is surprisingly simple. If an officer lures an ordinary citizen intocommitting a crime that this person would not have otherwise committed, then this is a legal act ofentrapment, which transfers the blame to the officer, who has committed the act of ? manufacturing acrime where none would otherwise exist. ? Then what is legal entrapment? Legal entrapment must include that the perpetrator has prior recordof committing the same or similar crimes that will lead the officer to believe that the suspect hasshown probable cause of the crime in action. During the questioning phase, the police will ask you a series of questions pertaining to the crime;and few of the questions will include reverse psychology and psychology tactics to trick you intosaying something that may or may not be true. Thus, the police do not have a right to lead you intosaying false claims, nor do the police have the right to threaten or abuse you during questioning. If you are innocent of the crime the best legal advice is to answer the questions calmly, however, ifyou are guilty and refuse to answer the questions, you should immediately ask to see a lawyer. Ifyou do not have the money to pay for an attorney, under law you have the right to legalrepresentation, which is handled by a court appointed attorney. Once you are sent to jail, the lawmust admit you to court within 72 hours and during the stay in jail (depending on the state), youhave a right to a speedy trial. While it depends on the state in which you live, if you are pulled over by an officer and the officerdoes not have a search warrant, then the officer does not have the right to search your motor vehicle. One of the best pieces of legal advice you can get is (if you have done nothing wrong) to force theofficer to get a warrant. Many people often ask questions, searching for answers to relieving debt. Under the law in most states, the debtor has the right to writethe creditors, asking for extensions on the debt or else pleading for leniency. Few debtors may offerto write off the debt or else may agree to an agreement on payments. Some debts may lead to lawsuits, thus why legal advice is needed in most instances. Legal Advice on Divorce Legal Advice on Debt Legal Advice on DUI and OUI Charges Liability Legal Advice Advice for Legal Pleas Advice on Legal Infractions Have you ever wondered what your rights are if you receive an infraction? An infraction is nothing more than a ticket and is not considered a crime. To handle an infraction, the person in question merely sends in a money order to pay the balance owed on the infraction, which is usually found somewhere within the citation. The citation will also have an address wherethe money can be sent. If you wish to dispute an infraction, you can write a letter to the appropriate sources in your stateand request a dispute, explaining briefly why you wish to dispute the infraction. This is the wisestlegal advice available, since disputes often lead to toss-outs --or rather the courts will often drop theinfraction. In a few states, infractions go against your car insurance, which is why protesting theinfraction is in your best interest. An officer once told me that if everyone disputed infractions or traffic violations, less people wouldbe paying the courts. With this information, I learned that the next time I get an infraction, I shouldsend my dispute letter to a professional. I personally suggest that you do the same. If you have beencited for an infraction, you should try to avoid fees and penalties if you do not need to pay them. Violations are slightly different than infractions. ... Wine Making¦ If You Plan On Drinking, Do These Critical Things Before You Leave The House Buy a Breathalyzer A Breathalyzer is a portable hand-held device in which you blow, that measures your blood alcohol level. Many good breathalyzers can be purchased on-line. Buy a good one. In general, they are priced based on their accuracy- the more expensive the unit, the more accurate the reading. For about $100 you can find a quality unit that is approved by the Department of Transportation. Do your research, buy one, and put it in your car. This is a critical first step in your protection against getting a DUI. It could be the difference between going to jail and going home to sleep in your own bed. Think about it: A $100 investment to avoid $10,000 in expenses and all of the time and hassles related to a DUI? Talk about a great return on an investment. Stop reading right now, go to the Internet, and purchase your Breathalyzer. It is that important. After you receive it, make sure you put it in your car. It does no good at home in a drawer. As a matter of fact, you should buy one for every car you own and keep it in there. Search Your Vehicle for any Incriminating Items Remember those empty beer cans that you threw in the back of your truck during your last fishing trip? How about that flask that you keep in your glove box, or in your golf bag in the trunk? Any remnants of marijuana in your ashtray? Any concealed firearms or knives? Now is a good time to go to your vehicle and get rid of any items that could be incriminating if you are stopped. When a cop pulls you over, he is trying to build a case against you. One of the ways he builds such as case is by simply looking inside your car for any evidence that you've been drinking. Don't help him build his case against you. What do you think your chances are of avoiding arrest if a cop walks up to your vehicle and sees several empty beer cans in the back of your truck; then sees a flask fall out of the glove box when you try and retrieve your registration; and shin+ ...

... Parenting Advice¦ Things To Teach Your Teenage Driver Is it hard to communicate with your teenager about issues in his or her life? Regardless of the communication problems, there are two issues you need to discuss with them: driving and insurance. The following are four things to teach your teenage driver. 1. Driving is a privilege, not a right. From a state's viewpoint, they will not hesitate to suspend or revoke a driver's license if too many violations are received in a short period of time. If the driver receives a DUI or is involved in an accident and he or she is not adequately insured the state will suspend or revoke a driver's license. From the parents' viewpoint: if the teenager is a minor or a dependant, the state may hold the parents liable for his or her actions. Also, since parents usually pay for the teenager's bills, they should be honest and let the teenage driver know that driving his or her driving privilege will be revoked by THEM, if she or he does not meet their expectations for driving responsibility or anything else. 2. Insurance for teenage drivers is expensive. Due to the accident statistics for teenage drivers, their rates start out high that is a fact. It only gets higher with accumulated violations. Also, with accumulated violations, the parents' insurance company and other insurance companies, may not choose to insure them. This lack of supply by insurance companies creates a higher demand, and as a result creates higher premiums. 3. Teenagers need to know there are consequences to their actions- especially if it involves auto accidents. The teenage driver needs to know that people get hurt and possibly DIE in auto accidents. Teenagers seem to be oblivious of their or anyone else's mortality. There are laws of physics that need to be understood when an accident takes place. Also, it may not seem cool, but the teenage driver needs to make sure everybody in the vehicle wears his or her safety belt. 4. Last, your teenage driver needs to avoid distractions and concentrate o× ...

One minute, he's full of vitality and attending our local high school, the next his unsuspecting parents are identifying him in a local morgue. The harsh reality of this brutal scenerio is sometimes very difficult to comprehend. "Where did I go wrong?" "Didn't I talk enough with my child?" "I thought he knew better..." "I assumed he was just at a friend's house..." These, and various other queries, are all similar questions parents tend to ask themselves after an incident or accident involving DUI or DWI (Driving Under the Influence, or Driving While Intoxicated). According to MADD (Mothers Against Drunk Driving), NHTSA (National Highway Traffic Safety Administration) and the NIAAA (National Institute on Alcohol Abuse and Alcoholism), Parents' drinking behavior and favorable attitudes about drinking have been positively associated with adolescents' initiating and continued drinking. (NIAAA, 1997) Youth who drink before age 15 are four times more likely to develop alcohol dependence than those who begin drinking at age 21. (NIAAA, 1997) Underage drinkers are responsible for between 10 and 20 percent of all alcohol consumed in the United States. (NAS, 2003) In 2002, 29 percent of 15 to 20-year-old drivers killed in motor vehicle crashes had been drinking. Twenty-four percent were intoxicated. Research continues to show that young drivers between 15 and 20 years old are more often involved in alcohol-related crashes than any other comparable age group. Alcohol-crash involvement rates, share of the alcohol-crash problem and alcohol-crash risk all reach their peaks with young drivers, with the peaks for fatal crashes occurring at age 21. (NHTSA, 2001) Based on the latest mortality data available, motor vehicle crashes are the leading cause of death for people from 15 to 20 years oõ ...

... had not gotten out due to his or her company's negligence. Business Week says that the average damages for Identity Theft victims are $92,000.00 and up per person. Using this statistic, if you have 10 employees lose their identities, then on average, your liability is $920,000.00. Statistically, you are responsible for an average of 75 bad checks and 8 credit cards per employee. The average Identity Theft victim also spends 600 hours getting their credit restored, which means that you will have 600 hours per employee, so potentially 6,000 hours for 10 employees, which you will be responsible for paying employees who aren't even at work, because they have taken time off to deal with the Identity Theft. According to John Gardner, co-author of Chicken Soup for the Entrepreneurial Soul, "The damages are devastating to any business." There are many problems related to people's identities that don't deal with credit issues. Contrary to popular belief, only 26% of identity theft issues relate to credit issues. The other 74% of the issues, according to Gardner, are related to the following four areas: Someone stealing your DMV record. Example: An identity thief wants to drive under your employee's name instead of theirs. This will help the Identity Thief to not get caught in cases of DUI, unpaid speeding tickets, etc. Your employee is then blamed for their driving record. Someone stealing your MIB record. This is your Medical Information Bureau Record. Example: An Identity Thief wants to have an AIDS test done in your employee's name, rather than theirs, or have their prescriptions filled using your employee's Medicaid or Medicare benefits Someone stealing your character identity to commit a crime in your name. Imagine this- your future employee comes to your child care facility, and everything sounds good about this candidate. However, you run a criminal background check, and find out that they have three arrests for child pornography and one for drug trafficking to minors. You bring the record to their attentil ...

... and I are. Although the cable modem costs about $50 a month, you can split it and without a drop in speed have two or three people in your home on the same hookup- that makes it very cost effective. I specialize in helping those who do, or want, to telecommute or as they say in Europe and the Federal Government, to telework. We have helped numerous people move in and work from home. The various government agencies are now pressing more and more people to telework at least a few days a week. If you go to the various federal web sites most if not all of them have criteria and jobs for teleworkers- check it out. And don't forget your favorite jobs anywhere- you may be able to work here and have a job in any other place on earth or at least any other place in America. Crime: Our crime, what there is of it, is mostly out of state speeders on the highways. Some of our visitors are of the opinion (right or wrong) that our major source of state income in Delaware is fines from speeding tickets. That is the primary function of our police on a daily basis. We are certainly not crime free but we are safer than most places. In fact of our serious crimes, most are DUI, Driving Under the Influence and still our statistics are that of a very peaceful and laid back rural area. Size and Density: Sussex County is the largest county east of the Mississippi River with 938 square miles! Sussex has almost the exact same size as the other two counties of Delaware combined; yet we have only about 15% of the state population with our 120,000 people. That relates to only 128 people per square mile, compared to almost 1100 people per square mile in our northern county, New Castle. Financial and Economic Vitality: Southern Delaware is uniquely a haven for the self employed. The economic vitality of Sussex County, especially eastern Sussex County, is primarily that of self employment in addition to jobs in education, law enforcement, lodging, health care, Real Estate of course, Real Estate law, residential and commercial building and constr¶ ...

... on my days off, I got up early so I could take Ted to work. Then something happened. I began to notice that I was the one paying for the cigarettes, the groceries, the restaurants, and the gas to take him to work. A seed of resentment and doubt began to grow. It had been three months now, and Ted's car still wasn't running. He had put no money away to get his own place. What was he doing with his money? We began to fight a lot. Finally one day, guns were blazing and I told him it was over and he needed to move out. After an unpleasant departure, Ted was gone, and I had my home back again. After a few months I met a new guy, "Collin." It was Christmas Eve, and I, having no family to spend the holidays with, was doing my laundry at a nearby Laundromat. Collin and I started up a conversation while transferring clothes to the dryer. He was very handsome, and we seemed to have everything in common. A few days after we met, Collin's roommate "got them evicted," he said, and asked if he could stay with me for a while. I said yes, and helped him move in. He'd had a DUI a few months back and couldn't drive. At first, we had a lot of fun together. We went out every night. Collin played guitar, and sometimes would play me songs for hours after we got home. We talked about everything. When we had been living together for about a week I got very sick. Collin woke me when he got home from work, and asked me to drive him to the bar. When I said no, a little hurt that he seemed so uncaring about my illness, he got very angry. I finally got up and took him. I started to notice bottles of bourbon came and went very quickly around Collin. When rent came due, he didn't have it. How was this possible? I'd asked him to pay very little, and he didn't have a car or any other bills, so what was he spending all his money on? Booze. It didn't take me as long to kick Collin out as it had Ted. Perhaps, I had learned and was applying my knowledge. Perhaps it was because the better I got to know Collin, the more he lost his te ...

... measure also brought in OT's Ian Allen and Adam Haayer for added depth. Arizona has managed to interject a lot of young talent on their roster via excellent drafting as evidenced by the fact that 13 of the Cards 14 draft choices from 2003 and 2004 are on the roster for 2005, and to think that 7 of those 14 draft picks from 2003 and 2004 are starters! Seattle can't seem to get out of their own way with regard to posting an overall win/loss mark of 35-31 over the past four years which has led to them being what is referred to as a "middle of the road" team, not bad enough to be in line for higher draft picks but yet not good enough to capitalize on opportunity when it knocks on their door. The Seahawks finished 2004 with an offense ranked 8th overall in the league but defensively fell from 19th overall in 2003 to 26th overall in 2004, the Hawks really didn't help themselves too much in the draft and instead concentrated on free agency to shore up their defense as 8 of their 11 free agent signings were defense related as they picked up two DE's, two LB's, two CB's, a DT, and a Safety. The Hawks brought in WR's Joe Jurevicius and Jerome Pathon to ease the release of problem child WR Koren Robinson who had an off season DUI, the loss of backup QB Trent Dilfer to Cleveland will hurt the Hawks tremendously if QB Matt Hasselbeck goes down to injury and RB Shaun Alexander is threatening to sit out most of training camp in protest of the Hawks not honoring him with a new deal, ahhhhhhh nothing but problems problems problems for HC Mike Holmgren. St. Louis by far has the best four year record of any team in this division with a win/loss mark of 44-26, however, the continued bad play calling and terrible clock management by HC Mike Martz has led to this team falling well short of expectations given this teams immense talent level over the past few years. The Rams have made the playoffs four of the past five years during Martz's tenure, however, bone headed play calling in 2000 led to a first round loss at the hands ¨ ...
